Given that this will likely cost vast sums of money in legal battles for Utah (that will probably be fruitless)…What are Utahns thoughts on this aggressive move ?
Sometimes the U.S. Constitution tells you all you need to know. The Property Clause gives the United States Congress the final power over every territory of the United States.
Of course, if members of the Utah legislature want to try secession then there are federal penitentiary cells waiting for them.
”Of course, if members of the Utah legislature want to try secession then there are federal penitentiary cells waiting for them.” – Richard Warnick
This is a very curious statement Mr. Warnick. While there are many who argue that Secession or self determination of government is an inherent right that no laws of man, country or nation can legitimately abridge, there certainly is no legal provision for succession as ensured by the adoption of the 14th Amendment and it’s declaration of national citizenship following the Civil War.
Still, I have been unable to find a specific federal law that makes it a Felony (a crime worthy of imprisonment) for state legislators to attempt Secession by the legislative process. This sounds very reminiscent of Stalinism and reminiscent of the reactions by the ex-Soviet Union to suppress decent as satellite states began murmuring about declaring their independence. Would you like to provide us with the specific information you used to form this opinion Mr. Warnick?
Is it your opinion that even talking about Succession should be considered treason; punishable by incarceration or worse?
I don’t think the federal goverment should be consuming state and public lands and then kick us the average public off these lands like has been done. I think it is about time a state stepped up to the plate. I know that Utah is not the only state upset with the goverment control over state lands I wouldn’t be surprised if Idaho followed 2/3′s of Idaho is controlled by the Fed. I believe mostly for the natural resouses that come from the state and they are not alone It wouldn’t be long until several other western states would also join in. Compare these to some other states like Alaska where 95% of the land is controled by the state. One of the only states still financially afloat.
I believe the goverment control should go as follows.
The Federal government should do only those things which the states can not do for themselves. State government should do only those things which the counties can not do for themselves. County government should do only those things which the individuals can not do for themselves.
Sometimes freedom is expensive. Sometimes rights require effort. Go Utah House.
